Property owner with no water, sewerage connection still must pay Icon Water bill

While the owner of a vacant block does not use a water or sewerage connection at his property, the ACT’s supplier of these services is still entitled to send him the bill for them.

Last week, the ACT Civil and Administrative Tribunal (ACAT) dismissed the owner’s complaint made after Icon Water began charging him for the services.

Presidential Member of ACAT Juliet Lucy said the owner had not applied for a water or sewerage account, did not have a meter and had not accessed the water or sewerage network for his vacant block.

But the Water Services and Sewerage Services Connection and Supply Standard Customer Contract for Icon Water includes these conditions in its terms:

“We may charge you for making water services and sewerage services available to your property even if water services or sewerage services are not connected at your property, including but not limited to vacant land and car parks,” the contract states.

“This is a charge for your property having access to our water network and sewerage network.”

Ms Lucy took into account the legislation when she ultimately dismissed the complaint.

“I have found Icon Water’s standard customer contract applies in these circumstances, by operation of law, and Icon Water is entitled to charge for making its water network and sewerage network available to the applicant, even where water services and sewerage services are not connected to his property,” she said.

Non-publication orders prevent more detailed reporting of the matter.

An Icon Water spokesperson said the organisation acknowledged the tribunal’s decision and noted how, in the ACT, water and sewerage supply charges were set by the Independent Competition and Regulatory Commission.

“A fixed charge applies to all properties where the water and sewerage networks are installed and available to the property,” the spokesperson said.

“Even if a property is not connected for services, the infrastructure exists and must be operated and maintained to ensure it remains reliable and can be accessed when needed.

“The supply charges are not for usage, but for the availability of the networks.”

Icon Water’s Standard Customer Contract is available on its website, along with detailed information about standard water and sewerage service changes.

How is a contract relevant being the terms of an account if no account existed?

If its to do with owning the property does that mean a bank is liable if they hold the title?

If the government service provider cam charge for a service not provided why even offer a service at all?

Seems more like an organised cartel, where the goons get paid either way.

There is something missing from this story. Surely the ability of someone to be serviced by infrastructure is done by rates.

Down Wallaroo Road which is in the Yass council, they pay for rubbish collection in their rates but have to pay a private contractor to collect it. All governments love a good scam!

It is not a service charge if you are not getting service. It is a tax everyone pays, for water infrastructure to be maintained.

Just because something is lawful doesn’t make it right or fair.
I personally find it hard to understand how an unconnected service can be described as available and therefore billable.

Can Foxtel bill me for their services on the basis that they are available to be connected. Maybe they would like the law to give them the same ability

Or billed for road maintenance when you don’t have a car because one goes past your house.

Comes out of the petrol excise. Unless you own an EV

I get that’s it’s the normal requirement, but how much of a scam is it. The current society we live in really is taking the — out of its citizens

That’s nothing new! About 35 years ago, I purchased a building block in Perth and I had to pay for water and sewerage from the moment ownership for the land was transferredd to me. The reason for this was that the services were available, however, the charges were a lesser amount until the house was built and I moved in.

In a similar vein, I own a vacant block of land in Junee and I have to pay for sewerage and rubbish removal, despite the fact that I have no bins.

And, when my house in Canberra was built, the builder arranged for the gas meter to be installed before the external walls were built. I was charged gas supply charges for the roughly six months until my house was completed.

So when you buy a block of land you automatically enter into a contract with Icon -talking to an Icon representative yesterday who said that they do not charge for anything! Even Icon employees have propaganda fed to them !
