The Chief Minister resigns as per Section 45, and then the appointed Deputy takes over as per Section 44.
How was Shane Rattenbury even in line for the role ?

The Deputy Chief Minister shall act as Chief Minister at any time when there is a vacancy in the office of Chief Minister or the Chief Minister is absent from duty or from Australia or is, for any other reason, unable to exercise the powers of Chief Minister.
